Terms of Service

1. Agreement to Terms

By accessing or using LootStash ("the Platform"), operated at lootstash.io, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

2. Description of Service

LootStash is an online marketplace that facilitates peer-to-peer trading of virtual in-game items for supported games, including Diablo II: Resurrected. The Platform provides listing, search, messaging, and trade coordination tools. LootStash does not itself sell, buy, or hold any virtual items. All trades occur directly between users.

3. Eligibility

You must be at least 13 years of age to use the Platform. If you are between 13 and 18 years of age, you may only use the Platform with the consent of a parent or legal guardian who agrees to be bound by these Terms. By using the Platform, you represent and warrant that you meet these eligibility requirements.

4. Accounts

To use certain features of the Platform, you must create an account. You agree to:

  • Provide accurate and complete registration information.
  • Maintain the security of your account credentials.
  • Promptly notify us of any unauthorized use of your account.
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion.

5. User Conduct

When using the Platform, you agree not to:

  • Post fraudulent, misleading, or deceptive listings.
  • Engage in scamming, phishing, or any form of fraud against other users.
  • Harass, threaten, or abuse other users via chat or any other feature.
  • Use automated bots, scrapers, or other tools to access the Platform without permission.
  • Circumvent or interfere with the Platform's security features.
  • Post content that is illegal, defamatory, obscene, or otherwise objectionable.
  • Impersonate another person or entity.
  • Use the Platform for any activity that violates the terms of service of any supported game.
  • Engage in real-money trading (RMT) unless explicitly permitted by the game's publisher.

6. Listings and Trades

Users may create listings to offer in-game items for trade. By creating a listing, you represent that:

  • You own the items described in the listing or have the right to trade them.
  • The listing description is accurate and not misleading.
  • You will fulfill trades in good faith once both parties have agreed to the terms.

LootStash acts solely as a facilitator. We do not guarantee the completion, quality, or legitimacy of any trade. All trades are conducted at your own risk.

7. Premium Subscription

LootStash offers an optional Premium subscription that provides access to additional features. By subscribing:

  • You authorize us to charge the payment method on file on a recurring basis at the then-current subscription rate until you cancel.
  • Subscription fees are billed in advance on a monthly basis and are non-refundable except as required by applicable law.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you will retain access to Premium features until that date.
  • We reserve the right to change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new price.

Payments are processed by Stripe. Your use of the payment system is also subject to Stripe's Terms of Service.

8. Intellectual Property

The Platform's design, code, logos, and original content are the property of LootStash and are protected by intellectual property laws. Game names, logos, and in-game item names are trademarks of their respective owners. LootStash is not affiliated with, endorsed by, or sponsored by Blizzard Entertainment or any other game publisher.

9. User-Generated Content

By posting content on the Platform (listings, chat messages, profile information), you grant LootStash a non-exclusive, royalty-free, worldwide license to display and distribute that content solely in connection with operating the Platform. You retain ownership of your content and may remove it at any time. We reserve the right to remove content that violates these Terms.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

LootStash does not warrant that the Platform will be uninterrupted, error-free, or secure. We do not guarantee the accuracy of any user-generated content, including item descriptions and trade offers. We are not responsible for in-game items lost, stolen, or misrepresented during trades facilitated through the Platform.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOOTSTASH AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR VIRTUAL ITEMS ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless LootStash, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

13. Dispute Resolution

Between Users: LootStash may provide tools such as user ratings to help resolve trade disputes, but we are not obligated to mediate or resolve disputes between users.

With LootStash: Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with applicable arbitration rules, except that either party may seek injunctive relief in a court of competent jurisdiction. You agree to resolve disputes on an individual basis and waive any right to participate in a class action.

14. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, the Platform, or third parties. Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will continue to apply.

15. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting a notice on the Platform or by email. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which LootStash operates, without regard to conflict of law principles.
